Failure to notify the DMV of the new address will be a violation of VTL § 509-8. The section simply states that all licensees are required to notify the commissioner (the DMV) in writing of a change of residence. This can be done through the mail, online, or in person at the DMV. If you move, the address on your license needs to be changed within ten days, specifically with the DMV. Unfortunately, changing your address with the Postal Service will not update any DMV records. You can then either order new documents or write the new address on the back of your driver license, non-driver ID card, or learner permit, and on the front of the registration document.
If you plead guilty or are found guilty of this violation you are facing a fine of up to $300 plus mandatory surcharge of $93 (exact fine is up to the judge). In New York City, the fine is $138. A violation of 509-8 does not carry any points. In our experience, the violation will not appear on your driving record either. Thus, it does not appear to be cost effective to fight this ticket.
