One of the most serious tickets you can get in New York State is Speeding in a Work Zone. The relevant wording of the sub-statute for VTL 1180(f) is as follows:
Except as provided in subdivision (g) of this section and except when a special hazard exists that requires lower speed for compliance with subdivision (a) or (e) of this section or when a lower maximum speed limit has been established, no person shall drive a vehicle through a highway construction or maintenance work area at a speed in excess of the posted work area speed limit. The agency having jurisdiction over the affected street or highway may establish work area speed limits which are less than the normally posted speed limits; provided, however, that such normally posted speed limit may exceed the work area speed limit by no more than twenty miles per hour; and provided further that no such work area speed limit may be established at less than twenty-five miles per hour.
Regular speeding tickets alone are costly. Work zone speeding tickets carry double fines, and it can cause astronomical increases in insurance rates. If you are convicted of two work zone speeding violations, your license will be suspended for 60 days. VTL 510(2)(b)(xiii). The strange thing about this rule is that there is no time-limit to the convictions. This means if you get one work zone speeding ticket when you are 20 years old and then another one when you are 80 years old, you will get suspended. A regular speeding conviction will come off your record after 3-4 years. A work zone speeding ticket will never come off. For these reasons it is almost imperative that you fight the charges with a seasoned traffic ticket attorney. It does not matter if you were in fact guilty. This does not mean you are not eligible for a modification of the charge.
