A violation rarely cited in New York State is for violating § 1166-b. This statute is similar to VTL 1160-b, which relates to making a left turn from one street to another street. 1166-b concerns making a left turn from a street to a driveway.
If a motorist is found guilty or plead guilty to this statute, they will get two points on their New York driving record. In New York City, the fine is $138. In towns and villages, the fine is determined by the judge that is assigned to the case. The minimum is $150 + $93 mandatory state surcharge. The biggest cost is the motorist’s insurance premiums. With such a violation appearing on the driving record, insurance companies are inclined to raise the bi-annual rates.
Text of the statute:
Required position for turning at alley, driveway, private road or onto property off the roadway. The driver of a vehicle intending to turn from a roadway into an alley, driveway, private road or onto property off the roadway, shall approach the turn as follows:
(b) Left turns from two-way roadways. The approach for a left turn from a two-way roadway shall be made in that portion of the right half of the roadway nearest the center thereof.
Whether the allegations are accurate or inaccurate, the charges can be disputed. It is not immoral or illegal to plead Not Guilty in response to a traffic ticket even if the facts are correct. When you plead Not Guilty it does not mean you are making factual claims.
