Vehicle & Traffic Law § 1163(c) is a rarely issued ticket in New York. It relates to the failure to signal when breaking, which is other words for brake light not working. In such circumstances, the police officer will typically charge the motorist with VTL § 375-18, which is considered an equipment violation ticket and does not have DMV points.
If a motorist is found guilty of - or pleads guilty to - VTL 1163(c), they will get two points on their driving record. The maximum fine is $150 + $93 mandatory state surcharge. With traffic violations appearing on a driving record, the insurance company will be inclined to raise the bi-annual premium rates. Thus, the larger cost of this violation is the increased insurance premiums.
The text of VTL § 1163(c) provides:
No person shall stop or suddenly decrease the speed of a vehicle without first giving an appropriate signal in the manner provided herein to the driver of any vehicle immediately to the rear when there is opportunity to give such signal.
