Not to be confused with 1120(a) or 1120(b)
Vehicle & Traffic Law § 1120-(c) is not a ticket that is issued frequently. Motorists are generally familiar with the requirement to keep to the right on a highway unless passing. But not as many know that you are also supposed to keep right on a road that has two lanes in each direction. If you are found guilty or plead guilty to VTL 1120c, three points will be added to your New York State driving record. The exact fine is determined by the judge with the maximum being $150 + $93 mandatory surcharge for a first-time offender. A conviction of this violation will appear on the driving record, and as such, you will likely see an increase in your insurance premiums for several years.
Upon any roadway having four or more lanes for moving traffic and providing for two way movement of traffic, no vehicle shall be driven to the left of the center line of the roadway, except when authorized by signs or markings designating certain lanes to the left side of the center of the roadway for use by traffic not otherwise permitted to use such lanes, or except as permitted under subsection (a) (2) hereof.
Contrary to popular belief, it is not illegal or even unethical to plead Not Guilty to charges that are entirely accurate. A Not Guilty plea does not mean you are claiming that the ticketing officer was lying or is mistaken. Rather, a Not Guilty simply means that you are availing yourself of your Constitutional rights and require the government to prove their case. Thus, any motorist that receives a traffic ticket can challenge the charges regardless of whether the charges are inaccurate, accurate, or partially accurate.
In New York, motorists can retain a law firm to handle their traffic ticket in its entirety. This means your lawyer can file the Not Guilty plea in court for you and make any necessary court appearances in your place. It is possible to get the charges dropped or reduced and the person that got the ticket would not have to leave their home.
